GSG-5 Owners NOW HEAR THIS !

Here is what has happened in the HK / GSG Lawsuit...

October 12, 2009

Re: Heckler and Koch, Inc. vs. German Sport Guns GmbH, American Tactical Imports,
Inc. Civil Action No. 1 : 09-cv-00039-WTL-JMS (S.D. Indiana)

For immediate release,

We are very pleased to report that the litigation filed by Heckler & Koch, Inc. against
German Sport Guns GmbH and its U.S. distributor, American Tactical Imports, Inc.,
together with all counterclaims, has been settled.

The terms of the settlement are confidential to the parties and cannot be disclosed. A
dismissal of the above-referenced litigation, and all of the party’s claims against each
other, is expected to be filed in the near future.

Attorneys for H&K will be issuing a statement. The attorneys for ATI have already
issued a statement announcing the settlement.

Production and importation of the original design GSG-5 ceased as of Oct, 8, 2009 with
the signing of the agreement. The remaining inventory now in the USA can be sold by
ATI, all distributors and dealers. ATI currently has GSG-5’s in stock.

All sales of the GSG-5 by ATI must conclude by January 31, 2010. ATI will continue to
service every firearm that it imports into the USA.

It’s really sad to see a smaller company getting trounced by a bigger one. It’s really stupid that any company can claim patent rights on a half century old design too. I guess when Colt unfairly spanked Heckler & Koch on what could have been a lucrative deal on caliber and gas system upgrades for all existing M16A2/A3/A4 and M4/M4A1 service rifles and carbines, HK decided to do a smack down on somebody else, and I guess GSG/ATI was the likely candidate. That’s too bad. Its practices like that that goes totally against the free market system. Just ask the end users in the pharmaceutical industry. Pharmaceuticals are so eaten up with patent rights and law suits, their prices are hopelessly and obscenely high and the industry has signed on with the philosophy that it is better to price themselves out of a lucrative market than accept honest competition in a free market environment.

That's kinda how it all works, would you like to spend millions in R&D (IBM) just to have some joker figure out a better way to make your product in his garage & sell it for 1/4th the price??

Oh, wait...that was Apple Computers

And then some Microsoft peckerwood comes along, steals your Apple OS idea, puts it in reverse on the screen, figures out how to really Market the 'New OS", (even though it doesn't work half as well as Apple's) and really kicks everyone in the bahoogies and tries to become a living God?

Oh, wait...that was Bill Gates...

Yep, that's how it works!!

Much of what you said is correct, but not entirely in context. Heckler & Koch was not the sole designer of the basic MP5 design. Much of it was wartime collaboration and many companies involved never saw a dime in profits during the final design and production many years after the war. In the case of Pharmaceuticals, much of the research is "adacemic research" performed by graduate and PhD university researchers in university facilities using tuition and federal funding. These universities and researchers never see a dime for their efforts from the market and they are fortunate to get honorable mention in medical and pharmaceutical journals while corporations reap the profits from insurance companies and consumers. If the market is rigged, then it isn't really a market. Yes, inventers should have certain rights over their research and development, but only within reason. To claim half century old designs and product development goes beyond reason, and in effect, slows and discourages others to be inventive and create competition. I think Western Europe stumbled into that pit years ago, and now we've fallen into the trap too.

i went to the gun shop yesterday and picked up another mag for mine before i could say anything the guy said they sold 3 gsg5 rifles in less than a week .after i paid for the mag i told him about the lawsuit and settlement and how they ain't gonna be able to make them anymore. i bet after i left they marked the price up on that last mag on the shelf.
