Not too many Illinoisans here I guess...
Anywho, I have heard from several people that there is a loophole in the anti-CCW laws here in the not-so-gun-friendly state of Illinois. I hear that if you carry an unloaded handgun in say, a briefcase (fanny pack, book bag, etc) that it is legal, as long as the magazine is in a different compartment.
Well like I said, the LOADED magazine would be in another compartment, or even a pants pocket. It would only take a few seconds to load the weapon. Sure, it's not ideal, but it's better than having NO weapon.
I got a few buddies from that area. Other then Cook County, from what they've told me, if they wanted to, the only place they can carry is on their own property. They could mow their yard with a .44 magnum strapped under each arm. But it's very unlikely they'll need them to defend themselves against from the mower. lol.
As for any loophole or not, an empty gun could just get you shot. And as the other poster suggests, you may as well just have a stick, but with a rock, you wouldn't have to be as close as with the stick...And to be honest, It's advised when you transport ammunition which is caliber specific to the gun you might also have in your possession, that it be in a locked case/area. And if you get pulled over, if the officer finds the gun and the loaded mag, and in his opinion feels they were/are in close proximity to each other, they could very well site you just the same saying it was within easy reach? Just takes one officer in a bad mood to pull you over and then you lose your rights???
Instead of Loop holes lets work together to get the laws changed other states have and counties in IL are working on it but we all have to work on not just some of us Let Crook county settle their own problems and lets start being Illinois not a suburb of cook county! Lets work together to get CCW passed in Illinois.
I'm all for fixing the laws, as I'm sure everyone else here is.
Ok, I pass by the Lane Bryant in Tinley Park at least once a week, which reminds me of that incident. Let's say I'm at Bestbuy. I'm browsing the laptops and I hear shooting and screams coming from the applicances section. 7 seconds after I hear the shots, my weapon is loaded and ready to go, and I can proceed to defend my life and the dozens of lives around me.
Or, I can just not carry any weapon at all. I'll go hide in the Car Audio section, and hope the psycho doesn't find me after he finishes off everyone else.
(4) Carries or possesses in any vehicle or concealed
on or about his person except when on his land or in his own abode or fixed place of business any pistol, revolver, stun gun or taser or other firearm, except that this subsection (a) (4) does not apply to or affect transportation of weapons that meet one of the following conditions:
(i) are broken down in a non‑functioning state;
or
(ii) are not immediately accessible; or
(iii) are unloaded and enclosed in a case,
firearm carrying box, shipping box, or other container by a person who has been issued a currently valid Firearm Owner's Identification Card.
Nicky, as much as I myself hate it, it is the law and unfortunately NO, you CANNOT have a firearm of any kind on your person, loaded or unloaded unless you're on your own property or at a gun range, where yes, even there there are rules we must follow. A concerning thing there is, there are some who even feel on our own property is still even a problem and shouldn't be allowed and those same also want ranges closed...Let's face it. There are those that simply only want police officers, national guard and military personnel to be the only ones allowed to have a firearm and even then it's only when they're on duty or at war.
Instead of asking if there's a loophole you can maybe abuse, why not follow the rules as they are, and when it comes to a loophole or anything else in life, just do the right thing. Don't make those pointing their fingers at guns and gun owners and those that say all the anti-gun crap, right.
Buckle up, me thinks it's going to become a very bumpy ride from here on in...Looking for a loophole that may or may not be there to me is a waste of time. Using said loophole only makes those who say they exist

I tried. I voted for a CCW law in Kendall county. It was defeated 54-46%.

My friend and I use to run trap lines. To dispatch the animals he carried a Colt woodsman. One of lines came right outside of town and we always walked it. wewent into a restrunt one morning and forgot about the gun on his side in open view. The restrunt was not within city limits. As we got our meals the town cop keep looking over at us and I started talking to him and he pointed out the gun on my buddies hip. I thought I was gonna bail my buddy outa jail that day but the cop said that as long as it was in open view not within city limits and not in any modes of motorised transportation it could be on his person. This was 5 yearsago I don't know if he was being truthfull or just letting my buddy off easy. But I know you can have a firearm on yer person as long as its expossed look at hunters they do it all the time on others property. Personally I carry open every wair I go outin the country here I never have been bothered by gamewardens or told I couldn't carry when on horseback or walking while on others property but I guees this is allways outside city limits.

Hate to tell you boys, but "We the people" down state despise all you northerners.Your people and politicians ruin a decent life for us down here. We would love to draw a line at the southern border of chicago suburbs and call us north and south illinois.
I participated in last years IGOLD day. Did you? If not, educate yourselves and if your serious about you gun rights take the day off and meet me there. We take to the streets and march up the capitol steps and confront our politicians face to face. Rep Hollbrook to me the problem is 50% of the people in illinois live 50 miles from the sears tower. So, If we could get rid of that obstical, everything would be hunky-dory here in the heart land.

I take offense to this. Don't blame Northern IL for Chicago.. I live north of Rockford, 2 miles from the WI state line, and I hate Chicago and what it stands for just as much as you.
I support our gun rights with $$$ every year, and due to my work travel schedule (can't take a day off when I'm out of state or country), I can't attend some events, but I write several letters (not just email) to my state representatives every year to keep OUR position on their minds.
Please stop pointing fingers at the entire Northern IL area for where the real problem lies..

the problem is northern illinois....the concealed carry referendums passed in southern illinois...obama only won 4 counties down here...there are some good gun owners up there that are doing all they can....but there are too many ignorant people that listen to eveything that daly and the demonuts say and believe it. we will never have concealed carry in illinois...not as long as chicago is part of illinois....ive done the igold thing but hell we can only get 1200 gun owners to come to that...the fanny pack carry is a gray area...ive read a little about it.....if i lived in chicago i sure as hell would have a gun stuck down my pants when i went out and take the chance....u can get a carry permit from pennslyvania that is good in several states for $20....thats what i did....at least when i travel outside my home state im legal...
Instead of breaking off into "S. Illinois", how about we all just work towards educating everyone on the topic, instead of just succeeding and leaving all us Northern IL people out to rot.
Like it would work, anyway. Northern WI and the U.P. of Michigan have wanted to get away from Southern WI for decades, and create their own state.. With Madison only 50 miles from the southern state line, Northern WI feels left out and not in tune with the southern part of the state, and you can imagine what the Yoopers feel like..
Anyway, you can see how far that desire got them..
