| Supreme court decisions I had felt that the Supreme Court would hand the Wash.D.C. gun ban decision back down to the lower courts. But based on their findings on limiting free soeech in political matters, the right of a property owner to do with their porperty as they wish,(actually you don't even own the property you own now)giving Gitmo detainees U.S. citizens rights in court, and now illegal aliens can stay in the U.S. and work for the right to become U.S. citizens,I believe they will make a decision on the second ammendment. If it follows the rulings that have come down lately,I expect a very bad day for the second ammendment and the right to defend ourselves in any way.It seems we are no longer getting interpritation of existing laws,we are getting personal opinions that advance some justices agenda. sam. | What they SHOULD do is not act on what they think it means TODAY, but what it meant to the FOUNDING FATHERS back then. That way we could properly understand the wording and go from there. |

Blog Entries: 6 | Here you go Wind... Interesting stuff, I kinda get what it is saying, but I still need a little interpreting! lol STATE OF OKLAHOMA 2nd Session of the 51st Legislature (2008) HOUSE JOINT RESOLUTION 1089 By: Key AS INTRODUCED A Joint Resolution claiming sovereignty under the Tenth Amendment to the Constitution of the United States over certain powers; serving notice to the federal government to cease and desist certain mandates; and directing distribution. WHEREAS, the Tenth Amendment to the Constitution of the United States reads as follows: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."; and WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and WHEREAS, today, in 2008, the states are demonstrably treated as agents of the federal government; and WHEREAS, many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States; and WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States. NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE: THAT the State of Oklahoma hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States. THAT this serve as Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers. THAT a copy of this resolution be distributed to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, the Speaker of the House and the President of the Senate of each state's legislature of the United States of America, and each member of the Oklahoma Congressional Delegation. http://www.ok-safe.com/files/documen...JR1089_int.pdf http://www.okhouse.gov/51LEG/Leg_Vot...e=okh01983.txt Sounds oddly familiar... like 1860 familiar! I guess what Montana said was basicly that the US government approved their state's constitution granting an INDIVIDUAL'S right to bear arms and said the US government at the time said the state constitution was in line with the 2nd Amendment and so approved it. They are saying if the SCOTUS sides with the COLLECTIVE'S right and not the individual's, then the US government is in breach of contract... more or less... I have to agree, and if the SCOTUS should NOT side with the individuals right, then Abraham Lincoln's words come to mind, in part: "...When it comes to this I should prefer emigrating to some country where they make no pretence of loving liberty — to Russia, for instance, where despotism can be taken pure, and without the base alloy of hypocracy." I like Oklahoma, but it's not a bastion of personal freedoms. And our legislature tends to be a buncha fum ducks, also. | |

| The the tenth amendment is what gives the states the power to govern themselves without government intrusion.... that was thrown to the dogs decades ago. The federal gov. is supposed to act on behalf of the states, not mandate state law making etc. A good example is when the feds strongarm states to impose a lower speed limit by witholding transportation funds, until the states comply. Otherwise known as blackmail via taxpayer money. |
