A good day indeed fellow humans with rights. Punks beware. All you congress critters who would infringe on our rights beware. Famous quotes are in order to show the contrast. Which world would you want to live in? 1 The very presence of firearms any where and every where deters evil. G. Washington OR 2 Our task of creating a socialist America can only succeed when those who would resist us have been totally disarmed. As I sit, and breath a sigh of relief... HOOYAH!!!!!! It's about time we see something good come out of that lousy den of thieves, and I ain't talking about the Supreme Court, I am speaking of the District of Columbia, the favorite workplace of crooks, and elitists, and it don't matter what side of the aisle they are on, they're a bunch of folks who need to go to jail, and leave the laws to honest folks. The trouble is, honest folks don't have the wherewithal to compete. I'm celebrating this momentous occasion! Gonna set off some bing-bang-boom!!!!!!

He's really trying to split hairs on that one. Would he prefer everyone get ARs instead? Shotguns? He had no real basis for this dissent, I think. I mean really...unloaded and disassembled or locked? How in the world does that allow for HD? Answer: it doesn't. also: "but others in the administration feared it could lead to the undoing of other gun regulations, including a federal law restricting sales of machine guns." Man, I hope. Scalia also said nothing in the ruling should "cast doubt on long-standing prohibitions on the possession of firearms by felons or the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings." Well duh. But I am very interested to hear Obama's response to this. He better smarten up and realize he'll lose the white, middle-class votes he needs if he says something stupid. And he'll deserve to. - Coeloptera | |

I'm happy for the folks in DC, who can now protect themselves from the evildoers who have flocked there, that being the safest place to do honest folks harm! They'll start flocking out of there, and looking for a new hunting ground, soon. Hopefully, folks like us won't allow any more free fire zones, for the bad guys!

| His voting record is anti-gun. I can't wait to hear this excuse on his part... WHEN he waffles... and he'll have to in order to keep voters, the people will see it and know he is an "empty suit" elitist. Last edited by LarryO1970; 06-26-2008 at 11:20 AM. |

Bad day for a criminal, elitist, or elitist criminal. I hope someone's keeping track of violent crime stats. It'll be interesting to show how (despite the years of rhetoric from the naysayers) you'll see crime drop as the good folks in the gun ban cities begin to get tools for their right of self-defense back, and criminals realize they can't prey on people anymore.

| We Won.. Sort of
Victory is rarely complete. But with the DC vs. Heller ruling, the Supreme Court enshrined into law most of what we responsible shooters wanted or realistically expected. Antonin Scalia, writing for the majority (5-4), struck down the DC gun law as plainly unconstitutional. He and his colleagues that concurred with him, Chief Justice John Roberts and Justices Samuel Alito, Anthony Kennedy and Clarence Thomas, confirmed that the right to keep and bear arms is an individual right, not the collective right postulated in US Vs Miller in 1939; the hook the antigunners have been hanging their hat on for decades. The Miller ruling was demolished by Heller. The ruling confirms the Second Amendment as codifying a pre-existing right to keep and bear arms, not the creation of such a right. The justices held that the right to keep and bear arms includes hunting and self-defense, and includes handguns as well as longarms. The tenor of the ruling is that the Constitution of the United States trumps policy and laws set down by states or municipalities. Scalia's opinon is not unalloyed, but is reasoned. He wrote that despite the Constitution guaranteeing a right to keep and bear arms, it is still permissable to ban convicted felons, those with a history of mental illness severe enough to have required hospitalization and other risky individuals from owning guns. It also allows laws forbidding the carriage of guns in places like schools and government buildings. From this, one may infer that systems like NICS, to verify an individual is OK to own a gun, are allowable. However, the ruling was silent on the legality of requiring licenses for particular types of guns. An analyst for CNN, Jeffrey Toobin, was of the opinion that lower courts will be working for decades to decide what restrictions on firearms ownership are okay and which are not. He expects lawsuits will be filed challenging existing ordinances and laws; and that as existing laws are challenged, municipalities (mostly large cities) will be frantically trying to rewrite laws so as to comply with Heller while still restricting ownership of military-type firearms. (Toobin, your typical talking head, did not define what he meant by "military-type firearms." Full-autos? Civilianized military designs like the AK-47 and AR-15? True machine guns? You tell me.) Bottom line: the Heller ruling is a kick in the crotch and a baseball bat across the chops of the gun-banners. They have had the legal underpinnings of their fascist leanings knocked out from under them. But they aren't dead yet. You can expect their activities to shift from the national stage to the state and local levels, to try and maintain restrictions like those in New Jersey, New York State, California and New York City. You can expect them to push for nonsense like microstamping and requiring all guns sold to have a spent cartridge case and spent bullet scanned in and kept on file with the FBI, the BATFE or some other government agency. You can expect them to try and get oppressive licensing requirements passed, that pay lip service to Heller but in fact ignore both it and the Second Amendment. In short, we pro-gun types won a major victory today, one that will make our lives easier in the years to come. This ruling will go a long way toward torpedoing nonsense like McCarthy's evil H.R. 1022. It may make it easier to legally challenge horseshit like New York City's infamous Sullivan Law. But despite this victory, the war goes on. Celebrate, but not too much. Keep after your local officials to make sure they don't pass some weasel-worded law that regulates your right to keep and bear arms away. Watch them like hawks. You can't trust them, especially the ones who've worked hand in glove with the United Nations, the Brady Bunch and their fellow-travelers before.
