Nebraska Legislature: Self defense

It's been dubbed the "make my day" bill, after the oft quoted line from a Clint Eastwood movie.State Sen. Mark Christensen of Imperial prefers to talk about the "castle doctrine" and about Nebraskans being able to defend themselves without fear of prosecution or lawsuits.If someone is breaking into your home, he argues, you shouldn't have to wonder whether the law thinks you are justified in shooting that person.

I wonder if the opponents of this law, the ones who've dubbed it the " 'Make My Day' Law," stopped to consider the context in which Harry Callahan spoke that iconic line.

He was drawn down on a teenage robber who was holding a waitress hostage and had a .45 to her head and was maybe 3 feet away from the kid. The kid looked at Harry's hand cannon and at Grim Death staring at him over the sights, and surrendered.

Harry wasn't backing away. Harry wasn't considering whether the law said he had to try other things before putting a round right between the kid's running lights. Harry was prepared to blow the kid away if he made one move that threatened the hostage, and the kid knew it. As Little Feat observed in "Gimme Three Steps," it ain't no fun staring straight down a .44. Most people in that position will rethink their options at that point.

This law has the potential to do far more good than harm. If the Bad Guys know that the Good Guys don't have to meet some absurd legal standard before they can commence firing, I strongly suspect there are going to be a lot fewer occasions when it becomes necessary for a private citizen to have to fire on a perp.

The Oklahoma Castle Doctrine legislation had the same nickname before it became law. There hasn't been the "explosive increase in legal killings and accidental homicides" the opponents of that legislation claimed would happen.
Opponents to Castle Doctrine legislation simply have the belief that the criminal has more rights than the homeowner.

Those opponents of the Castle Doctrine go by the name of "Trial Lawyers." This is going to eat into their illicit income for a long time.

They say we dont need this but yet a city and LEO are being sued because some dumby pulled a gun on the LEO and was shot and killed by the LEO.

From what I can tell, pulling a gun on a lawman of any kind fits into an unofficial categoy LEOs have: "Suicide by Cop." Anyone dumb enough to draw down on a police officer deserves what he gets. If the Internal Affairs people or the Shooting Board or whatever the outfit that investigates officer-involved shootings goes by declared it a "righteous shoot," where do the heirs or parents of the Darwin Award winner get off suing the city and the poor bastard who had to shoot the clown with the death wish?

Castle Law

We have such a law in Texas...it just makes sense, but it is sad there has to be a law to "give permission" to protect yourself, your family, and your property. As they say, "when seconds count...the police are only minutes away!"

I think that it is everyone's right to be able to defend themselves in their home or on their property. Unfortunately there are people out there that don't think that your god given right to live does not mean that "preventative medicine" is ok.

If someone is in my house without my permission, I am going to fear for my life and fix the situation. If secondary lawsuits come in (i.e. family members, etc...) there will be atleast one return lawsuit. If his family members had done everything to support the dead guy/gal... he/she would not have broken into my house.

All I want to so is be able to sleep safely in my own home. The one exception to the rule is... touch my children... you MAY live to regret it!

As far as LEO's are concerned, there are more stories of LEO's getting into trouble because they did the right thing than stories of those that abused their power.
