| I certainly believe from that conversation you don't have anything to worry about. I assume your a lawyer haveing law books and i assume when you sent the letter it had the law firm logo on it. I would inquire why you have to do the pawn ticket thing though, but I suppose thats something they have to do to exchange the pistol, because of the red tape. | I believe the only way I would sign anything accounting for the time I had the firearm is if they accounted for the time someone had it out of the store. sam. |

| Used for new or using your new and making it used likely violate your state's consumer sales laws. Most have mandatory minimum damages, and many provide for multiple damages to deter future conduct. I would assue your receipt would state "used" if it were sold as such. Good luck and have fun. |

| Well, apparently the story hasn't ended. I have left 5 messages for the guy who called me, and he hasn't returned my call. All I wanted to know is the status of the replacement pistol. Three of the messages were left with his secretary and two left on his cell phone. Previous to now I haven't mentioned the companies name as they seemed to be working with me. The company is Turners. Let the serious games begin! I think they want enough time to elapse to where they can claim I caused the wear and tear on the pistol. I haven't fired the Les Baer and it sits in my safe. | Call the atf and advise them of the situation....ask them to run a check on the seriel number which is the BEST way to see if the gun was pre-owned. If they pulled a switch from what was on your original aft check form, they are in some serious trouble.

| Hey Doc - I'm new to this forum and was fascinated by your misfortune. What gets me is the "pawn ticket". I don't think that I would sign one. Sounds like this is a way to cover their on rear. As a professional, you want to be civil in matters like this, BUT, when dealing with airholes like this, remember the golden rule. Do unto them before they have a chance to do unto you, again. |

If so that is sick. I worked as a Deputy Sheriff and later as a Federal Correction Officer. We did not have to wait as a Peace Officer or as a CO. Good Luck...

| Vintovki, Thanks for the concern. Yeah, we have the ten day wait, and only one pistol or revolver allowed every 30 days. Doesn't make any sense to me. If I were a younger man I would strongly consider moving to another state. Turners gave me a $300.00 store credit which I spent for ammo. New Les Baer won't be here for 16 weeks ! Doc |

You don't want to be signing anything that might lead investigators to think you were trying to mislead them. My guess was that a couple of enthusiastic young employees just couldn't resist the temptation to take your gun out and shoot the living !@#$ out of it, but you're right; there may be something deeper going on.

| Sounds like you were satisfied, but should this happen to anyone: First, I would ask for a full refund. You wanted a new gun, you did not get a new gun. If they don't want to do that...ask for part of your money back, to equalize the actual value of the gun when you received delivery of it. Say lost value was $400, ask for $450, $50 being for the hastle. If they don't, enligthen them of the following: Take them to small claims court. Contact the BBB. And, report them to your state gun association, most have them. This way the state gun association can get the info out and perhaps draw down the clientelle that use this vendor.

| I did phone the ATF people in Los Angeles and spoke with a very nice young lady. She informed me there was nothing they could do, but she did run the serial # on my pistol to see if it was stolen!! If it turns up "hot" they will confiscate the gun. Now thats what I call service ! |

| I would also notify the CA DOJ who handles the 10 day instant check in addition to the ATF field office in LA. You should not have to sign a pawn ticket as the will be receiving the pistol from you permanently and not for possible redemption. They may be concerned that the pistol has dropped off the DOJ approved list and they will be stuck with it and will have to sell it out of CA for an even larger loss. Most interesting. Check the DOJ web site to verify if the pistol is still on the approved list. |
