i believe some where on the form the local P.D. cheif has to review the application, and sign his approval. am i correct??? our Cheif has been busted for taking bribes, extortion etc. his replacement lasted a month and was indicted on similar charges. would this invalidate the license??? ya think??? |

I think Papa that you only have to send a copy to the Chief Police Officer informing him/her of your application. I might be wrong but that's the way I see it. I got my green form in the mail today. Took only two days to get up here from Phoenix. But, I was thinking someone on another post said you had to submit three different forms? I asked (on call messaging) for all three but only got the green form.

Yeah, Jerry said, in the other post, I also need forms 1370.3 and 5330.20 and I have no idea what those are or what they're for. I'll have to research it, I guess.

I found form 5330.20 and it's 'Certification of Compliance with 18 U.S.C. 922 (g)(5)(B)'. Basically it asks for someone to certify your citizenship. Dang. Am I supposed to send this to my mother...or who? I dunno, lol. Just curious why the ATF didn't send this to me. I still haven't found the other document though and it wasn't on BATF site that I could find.

All I got was the main form, and the one you send to your CLEO. Its pretty much honor system, you could say you sent it and don't, but I didn't want to take the chance. Your CLEO only replies if you have something on your record that he feels would stop you from getting your license. If I can get one, almost anyone can!

joe is right it could be a problem just be honest no problem with me i dont drink dont smoke, no arrests for any thing, im a good boy, it took me 3 weeks for my c&r

Papa (and anyone else interested), Being the cautious person I am I called the Phoenix field office and spoke with a young lady (gosh...I wonder if she looks as good as she sounded...mmmm) and here is the real skinny. The green form (5310.16) is the only form needed if the license is to only collect and privately sell C&R guns. The second page, for the Chief LEO is just sent to whomever is the first in line as the community chief.....be it Chief of Police if you live in a municipality or Sheriff if you live outside of a municipality. No one there has to apporve or sign the form. The Certification of Compliance with 18 U.S.C. 922 (g)(5)(B) or "Certification of Citizenship' form is only if you are applying for a dealer's license. The other form Jerry mentioned was an old form (1370.3 - sometimes still used until depletion by some offices) is merely for written request of certain various forms versus calling for them. I hope that clears it up.

but don't you think that if the CLEO that signed is crooked the BATF might recall those licenses for review??? thats my thinking on the subject. could you imagine BATF SWAT tearing up some ones house, because of a bad CLEO signature!!! |

Has the CLEO been accused...charged...indicted...sentenced? If not I would think the BATF would surely give him or her the benefit of the doubt. If you want send it to the next person up the ladder, i. e., Sheriff rather than a Chief Of Police. You're still covered. I think the main thing is the BATF wants to allow for local input on the license if the locals wanna. I really don't think the BATF cares who...as long as it's someone with local knowledge of crime data bases they might overlook during the background check.

joe is right its not that hard to get, however if you have dosmetic violence charges thats the big thing, or felonies, or high misdomeaners like resisting arrest, or threats to your neighbors, than its a breeze, remember they have a digital clearing house, your record if you have one is on a national computer base, and will fowl up attempts for a c&r license I had no problem
