SHARPES, Fla. - A registered sex offender who one year ago today was released from probation will go before a judge this afternoon to answer charges he possessed child pornography.

David Michael Gilbert, 38, of Chestnut Drive, Cocoa is charged with 28 counts of receiving and compiling child pornography, and two counts of failure to notify authorities of address change.

Agents with the Brevard County Sheriff’s Office Sex Crimes Unit arrested Gilbert on Monday afternoon after a relative of his former girlfriend called authorities. According to the arrest report, Gilbert had downloaded pornographic materials onto the woman’s computer and then tried to take the computer with him at a later date.
“Gilbert claimed he wished to change his Internet account,” said Agent Tod Goodyear. “The relative became concerned, realizing the actual computer was not needed in order to change an Internet account, so the hard drive was examined. That’s when more than two dozen images of children in various sexual acts with other children and adults were discovered in a downloaded file.”

Further investigation put Gilbert at the computer during the times of the pornographic downloads.

Gilbert has been booked into the Brevard County Detention Center on $30,000 bond and will face a judge at 1:15 p.m. today.

According to his file with the Florida Department of Law Enforcement, Gilbert pleaded guilty in 1988 of committing lewd and lascivious acts in the presence of a minor under age 16. He was sentenced to probation for 10 years and served no jail time.

As a condition of his probation, Gilbert was to check in monthly with the Florida Bureau of Probation once a month and register as a sex offender with the Florida Department of Law Enforcement. But his record of checking in has been spotty at best.

According to Clerk of Courts records, Gilbert has been arrested no less than five times for violating probation. In addition, in November 2003, a bench warrant was issued for Gilbert after he failed to register as a sex offender, a third-degree felony.

Gilbert's probation violations include:

> 1992: Gilbert arrested May 23, 1992 and later found guilty. He was sentenced to two additional years of probation and given credit for time served in the county jail. In addition, an electronic monitoring ankle bracelet was placed to help keep tabs on Gilbert's location, according to court records.

> 1995: Gilbert pleaded guilty and was sentenced to work on the Sheriff's work farm in Cocoa.

> 1998: Glbert sentenced to serve four days in jail.

> 1999: Gilbert served a weekend confinement in response to the conviction of violating his probation.

> April 2002. Arrested, charged with violating probation. Case was thrown out of court in July 2002.

In February 2003, Gilbert and his attorneys petitioned the court to release him from his probation status. A hearing was held Feb. 24, 2003 and the order was granted.
