Bills Would OK Guns In Cars While On Job

TALLAHASSEE - Florida businesses could face criminal charges if they try to stop employees from bringing guns to work in their vehicles, under proposed legislation.

Sen. Durell Peaden, R-Crestview, and Rep. Dennis Baxley, R-Ocala, have filed bills that would permit workers to have the guns on the employer's property as long as the weapons remain locked in their vehicles. Both proposals included provisions that shield companies from lawsuits in case employees commit crimes with the guns stored in their cars.

The proposals resemble an Oklahoma law that drew attention when a number of major companies, including ConocoPhillips and Halliburton, sued to have it overturned.

Supporters of such laws say they prevent companies from forcing workers to give up their constitutional right to carry firearms.

However, some companies say that banning guns from their property is mainly an issue of safety, not gun control or liability. Shootings accounted for three-quarters of the 551 workplace killings in the United States last year, according to the Bureau of Labor Statistics.

Such a measure could affect Walt Disney World, which does not allow its 57,000 workers to bring guns onto park property. Universal Orlando, which employs 13,000 people, has a similar policy.

National Rifle Association lobbyist Marion Hammer said they plan to make the bills (HB 129 and SB 206) priorities next spring.

"For a business to tell you that in order to come on to their property you have to give up your constitutional right is wrong," Hammer told The Orlando Sentinel.

Employers that try to stop workers from bringing in their guns could be guilty of a third-degree felony, punishable by up to five years in prison and $5,000 in fines, if the legislation succeeds.

"What we're trying to do is avert what we see as some backdoor gun control," Baxley said.

Bill Herrle, a vice president for the Florida Retail Federation, said the group questions whether the proposal would conflict with existing employment law and property rights.

Gov. Jeb Bush's office has not reviewed the bills, a spokesman said.

More than 350,000 people in Florida have concealed-weapons permits, according to the Department of Agriculture and Consumer Services. That doesn't include military or police personnel who don't require licenses.

I think the attempt at this is great but I have to ask...what is the reality of such a bill actually passing or passing and then being overturned later?

I hope it goes through and stays but you never know what the lefties will try and do.

I still think it is ridiculous to need a bill like this in the first place your car is your private property and nobody can limit the contents of the vehicle. Just do not allow searches and don;t openly advertise that you are carrying any type of gun.
