She interpreted the preamble, "A well regulated militia being necessary to the security of a free State," to mean the amendment protects the right of the states to have armed forces, not the rights of the people.

That doesn't fly; as the other two judges pointed out, every other place in the Constitition that refers to the states unambiguously says "the States" or something similar. They also pointed out that the original draft said country, not state, and when it was changed no one even debated the change. The founders were clearly using the term state as a generic form for nation or country in this instance.

It's the same argument used by the Ninth Circuit Court when it upheld California's assault weapon restrictions, by the way. On an encouraging note, the Ninth Circuit Court gets shot down by the Supreme Court about as often as all the others put together.

Among all the things Bush has done that I do and don't agree with, his supreme court nominations are one of the best things. I believe all his appointees are constructionists. Especially Chief Justice Roberts.

Question

A part that makes me think of the individual is the one that says "KEEP and bear arms." It is not like the gummint,federal or local keeping the arms in an armory,and issueing them out in time of need,but the PEOPLE having those arms in their possession all the time.
Does that make any sense to you guys?

That's what the 2nd ammendment is for: So that if we are invaded or attacked directly, we are already armed to the teeth. A man, or woman nowadays, fighting for their home or family will fight harder that one just fighting for their country. IMHO, anyway.

As an example of how far anti-gun proponents will stretch the language, I've read legal arguments that claim "keep" means to "keep up" (ie, maintain in working order), rather than possess in the home.

If DC had half a brain (I know, that's giving them too much credit) they'd just do what NY did and require a pistol permit. Anyone can own a handgun as long as you pay $190 and pass a background check.

What part of "shall not be infringed" (the right of the people to keep and bear arms) do these scholars (term used in the broadest of interpretations) not understand? No court ruling is needed....they spoke the same language then, as we do now, less the slang, of course. This argument, in my opinion is foolish and a waste of time. Our courts need to read the amendment and follow it's lead. This is why people hate lawyers and judges, because they twist words and invent meanings that do not exist...... Supported, of course, by those paying the bills (for justice[?])! It does suck but, there it is.
