Turn it in...quick. I know it's tempting to keep it, but there is such a world of shite just waiting if your friend keeps it. I'd suggest going into the nearest police dept, explaining exactly when/where/how he found it figure out a really really good story as to why you didn't turn it in sooner (don't tell them that you were thinking of keeping it) and hope to god that it wasn't used in a violent crime.

This will sound like an echo, but TURN IT IN..

I was watching a friend do a land survey a while back about 30 feet from a well used roadway, and we were using a metal detector to find missing pins. We came across a strong signal...we began digging and ended up pulling a S&W .38 Snub Nosed revolver in a plastic bag..

We saw through the wheel that it was loaded, and immediately set it back in the hole that we found it in. The police arrived, asked questions, and a detective took the gun out for a closer look, only to find that there was an empty brass casing aligned with the barrel...meaning it had been shot once and put in the ground.

We never heard back from the police...but I really don't want to know what that 1 shot was used for.

That was definitely the right move there, Bravo.

Personally, I'd turn it in after talking to the PD and explaining the whole story truthfully (without telling them about thinking of keeping it) and ask if/when it's cleared of theft or crime and there are no owners found, if I could claim it as found property, being able to legally own it.

Note: this would be without taking the gun with me to the station... or even better talk to someone over the phone, preferably a 'higher-up' at your local PD.

Depending upon how long the friend has had the gun, it may be better for him to have his attorney turn it in or set it up. The police will not bully him or abuse him with his attorney present. If he found it today, that's one thing. If he's had it several days or more...I'd call my attorney.

I would keep it. Just don't use it for self defense. There will come a day when your weapons will become illegal. At that point it will not matter. Oh I would give the paper bag back.

No, I don't think that's true. You go to an attorney for advice, not just because you're in trouble. It's not that unnatural for people to be intimidated by police, and to seek advice. If I had the gun for more than a day, I would rather have legal representation with me than to go it alone. If, however, I had just picked it up today, I'd feel okay turning it in.

First...if you turn it in, you're gonna lose it. Sorry but that's the way it is. Second...if you have a lawyer present you're gonna go from being suspicious to being a suspect in a crime. If it were me I'd go in and do something novel...TELL THE TRUTH...cops are usually pretty smart and have been lied to enough to know when someone is lying to them. Leave out the fact that you were thinking of keeping it, but other than that just tell the truth.
Third...to alan...I can't see the future so you might be right, but I have two things to say to you. In order to "outlaw" all guns you would have to have the cooperation of leo's whom the majority of are private gun owners/collectors. Do you really think that they are gonna turn in every gun they own but their service models. And also even if they do manage to outlaw them I'd rather contend with having illegal guns then having to deal with illegal guns that just happen to be involved in a violent crime.

For all it would cost in trouble, the price of a new gun really isn't that bad. Keeping it should be out of the question.

Part of my favoring leaving it where it lays is that forensics may be able to find something that they couldn't otherwise, and it takes you completely out of the equation. Then you can go home and buy yourself a new gun as a reward for helping LE solve real crimes.

At this point, it's not such a good idea to put it back in the original spot. This guy has already put his prints on the gun and has basically left his genetic fingerprint all over the place. Better to fess up to taking it and turn it in. Tell 'em where you found it and say that you took it meaning to turn it in and forgot on a busy day or something like that.

Lost and found

If you know someone, you can run a search on it.The manufacturer? If it's clean well... finders keepers. I bet Feinstein did it. It was probably left there for someone else to pick up or a hit man threw it away so some fool would come along and get the bad rap, the guy that found it should use caution.
