I'd say the answer to this one depends partly on where you live. I have friends and family in rural Arizona, and they'd see a free gun as manna from Heaven. The odds of getting busted with it are about zip to begin with, and the local LEO's know them and would probably believe them anyway. And if they ever had to use it they'd just dump it, and thank their lucky stars it wasn't connected to them.

On the other hand, I live in the PRK and there's no way I'm risking losing all my firearms and my rights. I wouldn't even pick that puppy up. I'd call the cops on my cell phone, and stand beside it until a uniform had it in his possession. Then I'd go home, and cry over a beer or two about having given up a shiny new toy.

That can clear the S/N for theft, but unless you fire it and check the ballistics on the bullet against a national database, there's still a chance it was used in a crime.

I'd pick it up with rubber gloves and sell it to ole Juan up on the north side, for enough $$$ to buy a newsed K-31, a case of 7.5x55 ammo, and a six-pack of cheap beer. Then I'd call my cousin Joe Bob and tell him that ole Juan done stole his pistol! Afterwards, I'd drink beer and clean cosmoline off of my new K-31 while watching Joe Bob and Juan take potshots at each other. This plan only works if your cousin is missing a similar gun, but if he is, it's beautiful!

Check local stories from up to 5 months ago where crimes/murders were committed w/ a 9mm and the weapon was not found.., do a simple search through the police of weapons reported stolen or missing (they have them) basic detective work ya know..


If your friend finds nothing of noteworthy report..get a new firing pin and be done with it..

depending on the state, a simple "I bought it from a elderly gentleman who said he needed the money" should suffice unless of course you live in Californiastan.

in AZ. YOU NEED NO SUCH PAPERWORK TO FACILITATE SUCH A TRANSFER...and it would be up to the Police to prove you wrong...and they have to have indisputable proof that your friend used it in any murder or ill fated happening that might accompany the firearm...the burden of proof is on their hands..

Just because he found it and didn't turn it in is not a crime...just do the research..

Well, I told him to take it back. If, in fact, it was clean, never used in a crime or whatever, he could be charged with Posession of stolen property. Not a good thing to have on a person's record. What he does from this point is up to him, I told him I don't want anything to do with it.

I just can't help but think it is one of some guys favorite piece in his collection. It almost has a mirror finish; it certainly wasn't collecting dust at the bottom of some storage box, that is for sure. I know how pissed and upset I would be if any of my guns were stolen, and how greatfull I would be if someone returned it.

If it wasn't locked up properly or secured, I do believe he has been taught a lesson that he should've learned when he bought the weapon.

My guns are protected by a large safe that is bolted to the floor and to the walls..if he can afford a gun of that quality he can afford the safe to protect it..

To say anyone 'deserves' to be the victim of a crime is wrong. While some people attract unecessary attention to themselves and sometimes ask for it...they don't deserve it.

I don't see this as a 2A issue at all. I'd turn it in right away, not out of any fear, but so if there's a chance it's been used in a crime, turning it in quickly could help the police catch the scumbag.

I'd be afraid to stand by it, i'd go to my car and call then leave if i was going that route, whoever used it has probably already killed at least 1 person, what makes you think they won't make you #2? the last thing i would do is hang around

yea, but you're not a common street thug, you're probably a welder or something

we got some at wal mart for $450 that will stop a common street thug, sportsmans has some for $2000 that are pretty heavy duty though

You really don't have enough posts for me to get into this with you.

This is a tough one but is you're willing to face the possibilty of jail time for a crime he didnt commit just for a new firearm in his collection? So i'd say think about that and whatever he decides!

First off how would I risk going to jail if no one knew I had it??? Like I said when firearms become illegal and it will happen. What difference will it make. Man you guys are hardheaded. Guns will eventually be banned because--a defense less society is a society that can be controlled. Your friend needs to turn it in to the cops a.s.a.p. He will have piece of mind when he buys his own legally later. He does NOT want to get charged with a firearms violation sometime down the road. It could screw his life up big time. Remember, good jobs would be out of his reach when he got out of PRISON!
