Now it isn't my step son but a old friend I'll send you a PM on details A.H.

Okay guys, what I am and am not looking for. I am not looking for anyone here to do my footwork for me. WHAT I AM looking for is anyone who can point me in the right direction as to resources or contact info which will help move my investigation of this mess along. Anyone having a suggestion or info is greatly thanked.

Dallas I am not asking for direct help, but obviously after being retired for some 12 years I haven't the contacts in LE I once did, I need pointing in a direction wherein I can find info other than what my friends family can find from an apparently uncooperative local authority in their area. The charges are federal I have been able to obtain a case number but absolutely nothing about the specic charges or anything about where and what evidence was actually discovered. My investigation leads me to concur that this is a set up and I intend to make every effort to find the evidence supporting that. I do however need someone either currently Federal or Tx State LE that can point me to more recent sources I can access.

EZ, if this situation is this important to you, I would tell you to go to a private investigator. You may try contacting family of the individual who is having the problem. They may be able to lead you to something you need.

I didn't really understand your first post. I am taking it someone was falsely accused and now faces charges which they are innocent of?

In any case, such things are not a light matter. A criminal defense attorney, private investigator, aliby, and people who can attest to the persons character are in order. I also would suggest a subpoena for all records the prosecutor intends on introducing into the case. If this deals with any financial fraud, try to get the defendants credit history, bank account records, credit cards, etc... and build a case against the prosecution and in defense of the defendant.

Do not allow the defendant to offer any statement to the police without an attorney present, no matter what good intentions he/she may have.

True enough CI but if you'd like more detailed info about this I can PM you. I am suspecting 1 of 2 people of orchastrating this fiasco for purposes of revenge. Plus I am certain the U.S. Marshalls service is being led down the primrose path by the nose on this one.

Something similar happened to a friend of mine. He was having a house built, he happened to also be the General Contractor on the job as well, so he was on-site most of the time.

He had a guy come in and install the wiring for surround systems in 2 parts of his house. Well, he confronted the guy when he found some wires were installed incorrectly. They were in the living room of the house, my friends house, when this happened. They got into the argument and the guy came at my friend with a pair of sheers. My friend wasn't sure what the guy's intentions were and instinctively, he reached to his back pocket and pulled out a large box-cutter knife. The guy ran out of the house screaming and yelling: "He has a knife, he has a KNIFE!"

The police got involved, apparently both my friend and the other guy called the cops about the same time, but the other guy got through first. My friend was arrested and charged with brandishing a weapon. (IN HIS OWN HOUSE!) He had to pay court fees and had to go to anger management classes. Luckily he didn't have to spend any time in jail, but the rest of the crap would amount to about the same thing.

He doesn't have the resources to take the city to court, so he just lives with it. Just before this happened, he retired and began living on only social security. He spent his nest egg on building that house, so didn't really have any left to start a civil suit against the city.

Colorado is home to "Make My Day" law as well as home-defense laws that allow you to feel safe in your home and able to defend it and yourself with lethal force. How this shittzle happened, I will never know. Though, the city he lives in has some nasty cops on hand, but still...I suppose it is more the DA than the cops, they were only doing their job. It was the azzhat DA that decided to go through with what they did.

EZ, if you already have the case number, it sounds like you need to submit a FOIA (Freedom Of Information Act) request, also known as a Public Records Disclosure request. This is actually a common thing and is done by reporters all the time to get as much information as possible before reporting (at least the ones that are reputable do this).

I have a friend over at OpenCarry.org forums named Lonnie Wilson that's very familiar with FOIAs and submitting them, as he's helped the legal OC of firearms in WA State greatly over the years and helped people fight bogus charges. He's not an LEO or an attorney, just a concerned citizen that has experience working through things like this. His profile is here: http://opencarry.mywowbb.com/users/27.html
You can feel free to join up over there and send him a PM, he's a good guy and I don't mind if you tell him I sent you his way.

I actually was assisting Lonnie this last week with an illegal citation of a Bellingham, WA man. I did the legwork of finding the report number so that he could fill out and send in the Public Records Disclosure request (which, by the way, could be found right on the B-ham PD's website, so you may be able to find the one you need online).

Hope that's a bit of help...

Sorry, I really don't know if I can be of much help. I don't think I'd tell you anything that you don't already know.
Don't use the public defender if you can help it
Ask the lawyer for the info from discovery
...sorry mental block right now, when I come to I'll think of more and edit this.

Thank You very much J-A-C, that may very well be what I need if I get no reply from the Marshalls Service...

Thanks George I appreciate it any help I can get is worthwhile whether or not the giver thinks it is or not. First rule of Law Enforcement. The tiniest detail can solve a case no matter how insignificant it's possessor thinks it may be.
