If the facts are as stated in the article, that conviction will obviously be thrown out on appeal. I can't help but wonder if something's missing from the story, it's such a weird case of injustice and prosecutorial misconduct.

Yes, it should be overturned on appeal. The scary fact is that it even was tried in the first place to even need to get to the appeals process. As Troy2K mentioned, is there more to the story that meats the eye? I mean if this were to happen to me, you can be sure I'd have a qualified gunsmith testify as to what caused it, fix it and test it and explain what he found.
Sure, I can say what I'd do and so could anyone else right? In reading this story to me it would appear so did Mr. Olofson. Not sure if the Pope or President himself testified it would have helped this poor guy. It's as if they had it out for him, or someone did anyhow? I wouldn't put anything past anyone these days when it comes to getting even. Might be good practice to get into not loaning ones firearms out unless your there?
Just the fact it states in this story the prosecution "would not" and I gather "didn't" disclose all of the information they had/have, which is a requirement under the law, in and of itself will get it overturned. That's unless they use this new Homeland Security or some new patriot act rule. If that's the case, we could all eventually be in a similar dilemma.
This guy was a drill instructor in the National Guard, what do you think they'd do to simple gun folk like us?
By the way, did anyone happen to click on the link to the Jews for the Preservation of Firearm Ownership? I couldn't get it to and it wouldn't play for me but the gist of that is they are all for protecting the rights of and for all firearm owners from the aspect of what happened to some of them personally and/or their ancestors. They know that's exactly what Hitlers' sorry ass did to them before he started executing them, he disarmed them. So for the Jewish sector, gun bans in this country have become a real personal interest for them.

To me is seems like a well thought out prosecution kinda like a couple of Border Patrol agents from l Paso. I mean surely the prosecuter didn't overstep his bounds in that trial either, right. If he had would they still be in prison?
I was just getting a smile back on my face, and now it's gone again. That legal system up there sounds krooked to me. Are they near Chicago and taking lessons? I thought we had the right to be exonerated in an open, public, honest court of law. Why don't they spend the same amount of time on criminals that they spend railroading citizens? Scotty
