this is ****ed up. this stupid bureaucracy bull****. i am so pissed. how can you charge someone for a mechanical malfunction? its like charging a driver for having their brakes not work in an accident

Seems as if everyone except the ATF knows it was a malfunction. I think the ATF knows it, just won't admit it. Trying to try something back door I think. And what's to say the person he loaned it to, didn't mess with it? Maybe someone is out to get him?

Angry Malfunction

This is the new police state all he wacko's have been talking about for 10 yrs. Instead of a lawyer he should of used a counselor at law and put an interlocutory on the judge for sedition and treason for violating the 2 nd amendment. This should be appealed, and proved by gun experts. This govt is going to make owning a gun so intolerable we will give them up. NOT! We are dealing with communists, here people.

The first clue to the BATF should have been that 800 rounds were fired on the range before the malfunction occurred. However, on another forum it said that Tucker had been found guilty and was awaiting sentencing.

That is so bloody ridiculous its not funny.I was on the pistol range during a mid week competition and one of the guys that owns a S&W 422 22lr pistol had something strange happen.As the time started for the match and he brought the pistol up to fire position he then released the slide and away it went.It promptly emptied the 5 rounds in the mag.The owner was shocked and put it away to be taken to the smith for work.Now what i dont understand about the story over there is how did the ATF find out about it?Loose lips sink ships.Some prick dobbed him in.There are a few members in our club that arent liked at all.They should wander off somewhere and die in my opinion.That is why im getting out of pistols and the whole club scene.To many dickheads.

If I was the guy that had the "malfunction", I would have said "Oh, I was bump-firing it... is that against the rules of this range? Sorry about that, I'll leave." Then go to the friend that loaned it to me, tell him his firearm MUST be looked at by a smith before firing again due to wear or malfunction.

Friends don't rat you out.

Heh. They do. I had a driver at my last job who was given a ticket for speeding and reckless driving because the van slid more than a block on ice and stopped on the back end of another van. He never went over 10 MPH in a 45 MPH zone.

I am never surprised at what people get charged for. Pissed off. But not surprised.

How does one get a speeding ticket unless the cop was tailing him or shot him with radar? This should be an easy win in court. Your driver did fight this charge??????????

If you rear-end someone, it's almost impossible to establish your innocence. I had a friend who was in a 26-car pile-up, and an officer walked down the line writing 25 tickets for reckless driving and following too close. He protested, "I was plenty far back! I stopped in time, and ten cars hit me from behind and pushed me on into the guy ahead of me!"

The officer shrugged and said, "tell it to the judge." He took a day off work to plead innocent and another for a trial, and the judge found him guilty.

Jeez! That's a stiff ticket, too! Guess we all need to get legal insurance so we can take an attorney with us when we go to traffic court. What has happened to common sense? You and I both know that there was nothing he could do. Just glad he didn't get hurt or killed.

so the guy in the front car can sue every car behind him right???because legally they just kept hitting him and the other cars!!!! the first guy will be richthe last guy will be screwed big time and everyone else in between well all the money the get from sueing they guy who hit them will be takin away by the guy in front of then that they hit so that makes the guy in the front car the lotto winner of the day. thats the american way right???
