Class III Newbie HELP

Do I have to apply for a class III license before I can put a suppressor on a .22 rifle, or is it just the matter of paying the tax stamp?

If I do need the classs III, is that super expensive, and do you have to renew your license every year or what?

Hi, RJ,

There's no "Class 3 License," unless you are going into the business of NFA firearm sales. To purchase a Class 3 item requires completing the specific requirements & forms for that item & paying the tax stamp. This process is repeated for each NFA item you acquire.

Your suppressor manufacturer or dealer will be familiar with the process and eager to help you.

It is a simple and complicated process..I know that makes no sense but it is true.
Basically, it is just a matter of paying the tax stamp and passing the background check.
First you buy the silencer. Then you fill out all the ATF paperwork for the transfer from your dealer to you, get your local CLEO to sign off on the paperwork (Form 4), get a passport photo, get fingerprinted, and submit the paperwork and fingerprint cards along with a $200 check to the BATFE. Then you wait....and wait...and wait...and wait some more.
Assuming you are not a criminal, and your check doesnt bounce, and your paperwork is filled out correctly, it will take anywhere from 2 to 5 months to get approved. The BATFE will then mail your approved Form 4 back to your dealer with a cool looking $200 tax stamp affixed.
At that point you can pick up your silencer (or machingun, or whatever NFA item you purchased - the process is the same for all NFA).


Understand that this is a very simplified explanation and does not address the differences in using a trust, various state laws, etc. Depending on your state, county, and CLEO this process can be super easy (Tennessee, Mississippi, Arizona, Nevada) or difficult up to impossible (Hawaii, Illinois, Massachutses, New York, New Jersey).

i bought a suppressor for my .223, i went to the city police chief and he flat out denied me. Does anyone have any suggestions or tips to get him or someone to sign the form 4

Go to your local Class III FFL dealer and tell them you'd like to purchase the suppressor via the "Living Trust" route.

I have a .45 H&K USP Tac and was thinking about purchasing a supressor for it. I was wondering if owning a supressor and the $200 tax stamp would wave my 4th Amendment rights as a FFL Class III would? I have a friend that has an FFL and the ATF just showed up at his house one day and went through his house and Freaked out his wife. No warrant needed so they said. Is that true? I also Live in MS and they have screwy laws about silencers but the local gun store assures me they are legal with the stamp. Any info woulg be greatly appreciated.

Short answer is NO you dont have to worry about BATFE knocking on your door and doing a warrentless search - that only applies to FFL holders who operate out of their homes (do a google search I dont feel like explaining).
Cans (silencers/suppressors) are perfectly legal to own and shoot in MS (provided your tax stamp is paid and you have your paperwork).

Regardless of where your business is the atf can only come in durring posted business hrs! If in you home they only have access to that part designated as your business location - in my case, my garage. They do not have access to any other part of my house.
On my FFL application I put "Open by appointment only, Sun thru Wed between 10 & 5" so they have to call and make an appointment to do a compliance check - thus I know they're coming. I also know they won't bother me on Sun.

If your garage has a door that accesses your house you may be in for a nasty suprise next ATF visit. theres a reason most FFLs do not operate from their homes anymore...
