Laws should be set up to enforce justice while protecting against abuse of the power used to enforce justice. Past convictions shouldn't be considered cause for future convictions, but past convictions should have gotten enough jail time, and enough reform work (work, not just counseling) to make the person less inclined to do it again.
Better for a guilty man to go free than for an innocent man to be punished. But when someone is proven guilty they need to really be punished. Enough of this system that doesn't take guilt or innocence as seriously as it should. If he's not proven guilty, he can't be punished. If he is proven guilty, he needs to be punished enough. As it is, the difference between a criminal and a free person is becoming less and less. There are so many petty crimes that are a joke to enforce, take media piracy for example. Then on the flip side your Constitutional rights are ignored when you choose to buy and use a firearm within the law, or to engage in business with them. You suddenly become presumed guilty, are required to divulge info no one else is, are subjected to warrantless search, and in some cases get branded a domestic terrorist for talking too much about the Constitution.
