It looks to me like a model 40. The model 45 had peep sights, no rear sight on the barrel and checkering on the stock. These rifles were made from 1928-1940.

The black paint on that stock is probably covering up some pretty walnut. I bought one a few months ago in .30-30 in near perfect condition for $375. It looks like it hasn't had but maybe a couple boxes of ammo through it. Mine doesn't have the peep sight or checkering on it. I wish mine was in .300 Savage. I've been itching for a rifle in .300 Savage.
