Records freeze

Colleagues,

I have spoken or corresponded with many of you since release and implementation of the "Air Force Record freeze" on 29 October 2003. Many of you have answered these same questions dozens of times. Me too, and all this correspondence on the freeze just adds bits and bytes to our record holdings! In an effort to help you provide information to the workforce I offer the following responses to the most frequently asked questions:

1. All records (regardless of media, record type or disposition) are frozen. All means all!

2. Implementation of the court order 3 years and 8 months after issuance is due to failure of Air Force to satisfy Department of Justice (DOJ) requirements to provide an all encompassing list of records to protect for the tobacco litigation in the case.

3. There is no one solution fits all for storage of these records. Solutions must be established at each site based on quantity, availability of space, etc. Funding issues resulting from the freeze must also be handled at the local level. You may request a waiver for early record retirement. When and if your waiver is approved, your records may be sent to a Federal Record Center.

4. Presently, there is no projected date to release us of the mandate of this record freeze. It is a preservation strategy and a means to comply with the tobacco litigation Court Order in the case of United States v. Philip Morris Inc., No 99-2496 (GK), United States District Court (D.D.C.).

5. AF/ILCXE will continue to negotiate with DOJ to identify the specific record series that require extended retention and those not applicable to the current tobacco litigation. I will inform you of any decisions from DOJ; in the interim, you must ensure retention of all records in your possession, custody, or control to include office holdings.

6. Records are defined in various statues, including the Federal Records Act and the Freedom of Information Act. The definitions is from the Federal Records Act that governs agencies' records management responsibilities.

Records include all books, papers, maps, photographs, machine-readable materials, or other documentary materials, regardless of physical form or characteristics, made or received by an agency of the United States Government under Federal law or in connection with the transaction of public business and preserved or appropriate for preservation by that agency or its legitimate successor as evidence of the organization, functions, policies, decisions, procedures, operations, or other activities of the Government or because of the informational value of the data in them (44 U.S.C. 3301).

Nonrecord materials (Destroy these) -- those Federally owned informational materials that do not meet the statutory definition of records (44 U.S.C. 3301) or that have been excluded from coverage by the definition. Excluded materials are extra copies of documents kept only for reference, stocks of publications and processed documents, and library or museum materials intended solely for reference or exhibit.

for vets, AF at any rate that may need to pull military records. There is freeze, for how long it dosen't say. just info.

I've tried to get some records or info about my tour in Korea and with the SAD.

So far I can't find anything...almost like we didn't exist. So withholding records is nothing new for the dang military. Especially from those who need the records for benefits...bastids!
