It is as I first suspected. However I wouldn't lose any sleep over letting this guy off the hook. I can't see charging him because it is apparent that he hit what he was aiming for; the tire. However if there had been bullet holes all over the place I might be inclined to see him do some time for reckless endangerment.

As reported in the Democrat and Chronicle, Friday, Jan 11, 2008......"An Ontario County auto salvage yard owner who originally faced a felony criminal mischief charge pleaded guilty Wednesday to a disorderly conduct, a much lesser charge". John O'Connor paid $245 in fines, $100 in fine, and $145 to cover damage to the car he shot.

OMG! They made the guy pay for the tire? THAT is a total travesty of justice!. The dirtbags will probably get some slick shyster to sue the business owner for causing them to crap thier pants.

I don't think he was patient enough; he should've turned down that offer and waited for a lower one.

But they probably did him a favor (on purpose) with that $145.00 for damaging the tire. If the dirtbag who owns the car took the money it counts as a civil settlement, and he can't come back on the guy and sue him now.

I paid my wife's ex-husband sixty bucks for a doctor's visit, after he sic'ed the Sheriff on me for punching him in the teeth years ago. He was totally PO'ed when he found out later he couldn't sue me because he'd already accepted payment...
